New York State Supreme Court Judge Jeffrey K. Oing decided today that J.C. Penney can continue to sell its Martha Stewart merchandise, as long as the stores do so using its JCP Everyday label, the Times reports. Oing referred to former CEO Ron Johnson as "the architect of this entire dispute," and added that his departure from the brand at the beginning of the week helped the judge make his choice. The move prevents J.C. Penney from having to dump about $100 million of housewares in a back alley. But the arrangement is temporary; as the Times writes, "Macy's [can] come back and claim harm once the actual sales data came in."
